When someone is injured due to the negligence or fault of another –in a car accident, for instance, or on someone else’s property – the injured person may have a personal injury claim against the negligent and responsible party.
Usually, then parties can settle the matter with the insurance carriers without further legal action (litigation). When this is not possible, a lawsuit is filed and, if the matter is still not resolved amicably, it will likely be decided later by an arbitrator, judge or jury.
Insurance companies have one goal – to make as much money as possible, and spend as little money as possible, for their shareholders. It is the shareholders, and oftentimes not you, who are “in good hands.”
If you are injured in an accident due to the fault of another, that person’s insurance company will work hard to deny liability (responsibility) on behalf of their insured for your injuries. Even if liability is clear, they may seek to minimize your injuries, or deny they were caused by their insured’s acts. Or they may argue your injuries “pre-existed” the accident.
This might even be the case with your own insurance company. For instance, if you were injured in an accident by someone who didn’t have insurance, but you had “Uninsured/Underinsured Motorist” (UIM) Protection (fortunately!), your own insurance company may not believe your injuries are as serious as you know they are, or that the accident was the other person’s fault simply because you say it was.
The same goes for Personal Injury Protection (PIP). This is the part of your insurance policy that you pay extra for, so that if you are injured, your insurance company will pay for your medical bills. Though it might sound simple, depending on the circumstances your insurance company may challenge or even reject your medical provider’s bills. They may question whether or not you really need additional recommended treatment. They may even require you to submit to an Independent Medical Examination (IME) with one of their hired medical experts to see if you are in fact as injured as you claim to be.
One thing is for sure: the last thing the insurance company wants you to do is talk to an attorney. They know if they can get to you first, they might be able to persuade you to settle your claim with them quickly, or convince you that you don’t need to do anything to protect your claim. This may sound paranoid, but it is not.
