There are three ways to prove a medical malpractice case. They are outlined in RCW 7.70. The first is to show, by way of an expert witness, that the doctor who caused the injury acted in a manner that fell below a “reasonable standard of care.” The second way is to show that the doctor promised the patient that the injury complained of would not occur. Third, where the patient did not give his or her “informed consent” to the procedure and/or the side-effects associated with the action, a case may be brought. RCW 7.70.030.
